CH Services CH Services can help UK based contractors with information and support on possible responses to enquiries into what HMR&C describe as "contractor loan type avoidance schemes" or "CLAS" Working with thousands of contractors, CH Services draws on its wealth of experience and network of advisors to provide a timely and knowledgeable overview of all of the options open to the Contractor. Contact Us The CH Services Team CH Services boasts a highly competent and skilled team of compliance specialists, with extensive experience across the risk, compliance, back office, legal and audit functions within major blue chip financial institutions. At CH Services we pride ourselves on constantly monitoring the evolving tax landscape to be best placed to help our Contractors to understand their current position, HMR&C communications and the routes forward. We are a third party that was retained by your provider to help you to understand, when you receive correspondence from HMR&C, your possible response options. To that end we hold the transactional "books and records" of your provider. We were not retained to defend the provider or the scheme you used from challenge. What can CH Services do for me? If you: Are a UK based contractor (or have previously worked as a contractor) Have previously legally sought to minimise your tax burden through what HMR&C describe as "CLAS" between 2011 and 2014 Have received correspondence from HMR&C such as an enquiry notice, request for historical information etc CH Services can help you to fully understand all of the possible options open to you. We can also introduce you to our network of tax advisors (at your own cost ) should you need specific tailored tax advice. Why do I need CH Services? Under the Taxes Management Act (TMA 1970), HMR&C has the right to open an enquiry and ask the tax payer any questions they deem necessary. Remember that an enquiry can be opened for any number of reasons - ranging from a reduction in declared income, inconsistencies versus previous returns, the inclusion of a DOTAS number, etc, etc. The tax landscape has changed dramatically in recent years. The number of tax enquiries opened by HMR&C into contractors tax affairs has reportedly more than doubled. Additional powers, given to HMR&C in July 2014, to collect "tax in dispute" upfront have further raised the stakes. DOTAS - typically the arrangements used in the year under enquiry will not have been DOTAS registered - hence HMR&C will not know how the arrangement worked and so the letter will ask for that insight. Remember also that at present the APN regime does not allow APNs to be issued to non-DOTAS arrangements. When you're a busy contractor, likely working away from home for most of the week, receiving correspondence from HMR&C about historical " arrangements ( for TY2011/2012, TY2012/2013, TY 2013/2014)" can be a daunting and confusing experience. Knowing what is driving these requests from HMR&C can be key to securing the best possible outcome. You may be able to contact the promoter of the scheme(s) in question for support. Many promoters, however, no longer exist. That is where CH Services can help you. If your promoter was one of a number who had the foresight to retain our services prior to ceasing trading, you will be eligible for some pre-funded support. If your promoter didn’t retain our services, we may still be able to help on a "pay-as-you-go" basis Common FAQ's Q: Do you only handle complex HMR&C-related issues? A: No, although that is one of the areas we specialise in. We also provide consultancy on Risk & Compliance amongst other things. Q: Do I have to pay to use your services? A: If your promoter has engaged us then they have typically pre-funded the support we offer - meaning that unless we advise you otherwise, the cost of support has been covered. Q: I’m busy. Can’t you just become my tax agents and take care of HMR&C for me? A: Unfortunately not. We are not registered to be anyone’s tax agent. We can however offer you access to our network of specialists who provide these services. Q: What is your connection to the providers I used back then? Are you a part of them? A: No, we are not part of their business but if they have retained our services to support you in future, then we consider them our clients. We are simply here to help you understand your options with clear, independent, fresh thinking. Q: Can I ask CH Services for tax advice? A: No, CH Services are not technical tax advisors, so we are not in a position to provide you with individual tax advice. We are experts in the administration of tax in particular in the resolution of enquiries into an individuals tax affairs. Where arguing a particular technical point with the revenue we engage with the appropriate tax specialists. Why not get in contact to see what solutions we can provide to you today? We are contactable Monday to Friday, 0900 - 1700. Please complete the fields with as much information as possible as to what service you are in interested in and we will come back to you within 5 working days. If you have received correspondence from HMR&C then please consider the following before proceeding: Read the entire letter carefully (and any accompanying info factsheets), being sure to note/check the tax year to which it relates. Cross reference the letter with your own records - for example payslips, bank statements, your tax return, email notifications, etc Have you used more than one arrangement in that tax year - if so, have you reached out to all the providers you used to establish the support level (if any) available? Have you been through previous enquires - what is the current status of them? If you have engaged an accountant/tax advisor already and made them aware of the letter, then what have they suggested you should do? Any supporting info: Your company's name: Is your HMRC letter similar to this? No Yes Please return to the form and upload a copy of the letter received under 'Supporting Documents'. Continue Crucial information to consider These are your tax affairs and your responsibility! 1/ Two variants on this letter, self-employment & employment/PAYE. Important to check which you have received. If you received the self-employed letter but had not been so in the period, the focus of the enquiry is incorrect and this may be a “mistake” by HMRC. Ensure you completed a tax return in the period. If not receiving a letter opening a compliance check into it might also be a “mistake” by HMRC. 2/ CHS were retained and pre-funded by the scheme you used in the period to help you to better understand why we believe you have received correspondence from HMRC (see below) - and what your response options to it are. However, remember we are not tax advisors so are unable to provide advice as to which is the appropriate option for your personal circumstances. We can happily tell you what the majority in your position are doing if you wanted to take a “strength in numbers” approach. If you want us to introduce you to a tax advisor (at your own expense) then we can do this – just let us know. 3/ We believe that whilst the opening of a Compliance Check is formal, the accompanying request for you to provide information to HMRC is informal and at this time there is no obligation in law for you to provide anything to HMRC. The “deadline” noted in the letter feels purely arbitrary to us. Accordingly, it is entirely up to you if you co-operate - but if you do choose to offer anything up (which is within your possession), you can likely expect a raft of follow-up questions. Be careful when opening that particular door. 4/ If you were employed in the period by a DOTAS-registered scheme, then HMRC opening a “compliance check” is simply them ticking the box to enable them to issue you with an Accelerated Payment Notices (APN) in future. If you are not familiar with APN’s, you should seek tax advice because these are highly controversial new powers and have changed the game in terms of HMRC’s ability to collect tax. Based on the information you have received please confirm which of the below is most appropriate: A - I would like clarification on parts of the above information and my preferred method of contact is via telephone. (Please ensure you list at least 3 alternative dates and times that we may contact you on during the next 5 working days. This should be added to the information box before submitting your information). B - I would like clarification on parts of the above information and my preferred method of contact is via email. C - Based on the information I have read I would like to be referred to an advisor (Please note this would be at your own cost). D - I have understood the information so far and do not require any further contact at this moment in time. (Once you have made your selection above please continue to submit the form so that we may record your details and if need be provide updates of any pertinent information/developments regarding HMRC's investigations) Continue CH Services Limited.
