To that end we hold the transactional "books and records" of your provider. We were not retained to defend the provider or the scheme you used from challenge. What can CH Services do for me? If you: Are a UK based contractor (or have previously worked as a contractor) Have previously legally sought to minimise your tax burden through what HMR&C describe as "CLAS" between 2011 and 2014 Have received correspondence from HMR&C such as an enquiry notice, request for historical information etc CH Services can help you to fully understand all of the possible options open to you. We can also introduce you to our network of tax advisors (at your own cost ) should you need specific tailored tax advice. Why do I need CH Services? Under the Taxes Management Act (TMA 1970), HMR&C has the right to open an enquiry and ask the tax payer any questions they deem necessary. Remember that an enquiry can be opened for any number of reasons - ranging from a reduction in declared income, inconsistencies versus previous returns, the inclusion of a DOTAS number, etc, etc. The tax landscape has changed dramatically in recent years. The number of tax enquiries opened by HMR&C into contractors tax affairs has reportedly more than doubled. Additional powers, given to HMR&C in July 2014, to collect "tax in dispute" upfront have further raised the stakes. DOTAS - typically the arrangements used in the year under enquiry will not have been DOTAS registered - hence HMR&C will not know how the arrangement worked and so the letter will ask for that insight. Remember also that at present the APN regime does not allow APNs to be issued to non-DOTAS arrangements. When you're a busy contractor, likely working away from home for most of the week, receiving correspondence from HMR&C about historical " arrangements ( for TY2011/2012, TY2012/2013, TY 2013/2014)" can be a daunting and confusing experience. Knowing what is driving these requests from HMR&C can be key to securing the best possible outcome. You may be able to contact the promoter of the scheme(s) in question for support. Many promoters, however, no longer exist. That is where CH Services can help you. If your promoter was one of a number who had the foresight to retain our services prior to ceasing trading, you will be eligible for some pre-funded support. Important to check which you have received. If you received the self-employed letter but had not been so in the period, the focus of the enquiry is incorrect and this may be a “mistake” by HMRC. Be careful when opening that particular door. 4/ If you were employed in the period by a DOTAS-registered scheme, then HMRC opening a “compliance check” is simply them ticking the box to enable them to issue you with an Accelerated Payment Notices (APN) in future. If you are not familiar with APN’s, you should seek tax advice because these are highly controversial new powers and have changed the game in terms of HMRC’s ability to collect tax.
